Abstract

In light of India's current efforts to conform to the standards of Society 5.0, this study investigates the dramatic impact that the court and judicial activism have had on the country's human rights environment. This research examines the impact of the judiciary on the development of a socio-legal framework that can adapt to the ever-changing nature of modern problems by looking at landmark court judgements and their consequences. This analysis takes a look at how judicial activism has changed over the years, the strides it has made in protecting basic rights, and how it may support the ideals of civilization 5.0, a new social paradigm in which technology and human civilization are seamlessly integrated. There are several aspects from which the judiciary's influence is examined, such as the preservation of the environment, gender equality, LGBTQ+ rights, digital privacy, basic rights recognition, and more. We will take a look at the pros and cons of judicial activism, highlighting how important it is for societal inclusion and power balance. In addition, it foretells the judicial branch's future stances on digital rights, equitable access to technology, algorithmic accountability, climate justice, and international cooperation on human rights as they navigate the intricacies of Society 5.0. This paper argues that in India, as the country enters the Society 5.0 age, the future of technology and human rights must be shaped by the proactive role of the judiciary, directed by judicial activism.
