A BRIEF EXPLANATION ABOUT “HUMAN RIGHTS OF WOMAN” IN THE SOCIETY

Human rights as such are those rights which an individual being human being is entitled to and which in civilized society are recognized and enforced. The woman in the society have always been considered subordinate to man. During Vedic period, woman enjoyed a fair amount of freedom and equality. Human rights of women have been violated by unjust acts. For the protection of the rights of woman in society, different types of law have been enacted at different times not only in International but also in National. Article 4 of the Beijing Declaration provides that all appropriate measures shall be taken to ensure to woman on equal terms with men without any declaration. A woman can neither be rendered stateless nor can be forced to adopt nationality of her husband. The principles of Equal remuneration Convention was that men and women must be given equal remuneration for equal work. Special provisions have been made in Indian Constitution for woman against discrimination. The provision of section 3 of the Dowry Prohibition Act 1961, provides for penalty for giving or taking dowry, punishable with imprisonment which shall not be less that fifteen thousand rupees. The human right to marry and found a family has been protected under the Personal and Special Marriage Laws of India. Human rights against exploitation, right for maternity benefits, facilities in factories for women workers, equal pay for equal work with men have been provided in the provisions of Labour Laws of India. No discrimination shall be made while recruiting men and women. Every woman worker shall be entitled to maternity benefit. The majority of Indian women have no knowledge about their legal rights. Legal awareness are required for the protection of women’s right.Metrics
