Abstract

The Indian justice system is an intricate system which has been enacted to help the rule of law, safe the community and deliver justice to the sufferers of the crime. (Naik, 2024). What is critical is a thorough review of the current state of the system identifying what is negative, and the potential impact of these proposed legislative changes (Thomas, 2024). The existing system, which follows the British Model of police, which has its origin in the colonial era, consist of the police who investigate and arrest the accused, prosecution presents the case before the court, it is the judiciary that adjudicates the guilt or innocence in some cases, as for the correctional services which has the mandate on the custody and welfare of offenders. Yet the system has its own set of challenges, including systemic delays, massive case load, infrastructure bottlenecks and issues of fair trial and access to justice, which have limited the efficacy of the system and eroded public confidence. The new penal laws to be introduced are to be a basis for a restructured criminal justice system in India where crime would be tackled more promptly and effectively (Naik, 2024). It is an opportunity to turn the page on decades of criminal justice administration.
