Abstract

Proportionality is also one of the sentencing principles in India and it mandates the level of punishment must fit the level of crime (Fitri, 2020).This principle guarantees that criminal law is the ultimumremidium and solving violations with sanctions which only focused on depravation of freedom as the last option (Fitri, 2020).When deciding on a sentence, courts take into account the nature and severity of the offense, as well as the characteristics of the offender and the harm to the victim.
