RECENT LEGAL STRATEGIES FOR COMBATTING GENDER-BASED VIOLENCE IN INDIA: A CRITICAL ANALYSIS

Abstract

Gender-based violence (GBV) remains a pervasive issue in India despite progressive legal reforms. This paper critically examines recent legal strategies aimed at combating GBV, analysing their effectiveness, limitations, and societal impact. The evolving legal framework, encompassing legislative amendments, judicial interventions, and policy initiatives, serves as a focal point for this critical analysis. India has witnessed significant legislative advancements in addressing GBV, such as amendments to the Indian Penal Code, the Criminal Procedure Code, and the introduction of specialized laws like the Protection of Women from Domestic Violence Act. However, the implementation and enforcement of these laws often encounter challenges, including systemic barriers, societal norms, and inadequate resources. A critical evaluation of these legal strategies necessitates an exploration of their societal impact. Despite legislative advancements, societal attitudes and cultural norms perpetuate a climate where victims hesitate to report incidents of violence due to fear of stigma, retribution, or lack of faith in the justice system. Additionally, gaps persist in providing comprehensive support services and rehabilitation for survivors. This analysis underscores the need for a multi-dimensional approach that goes beyond legal frameworks. Collaboration among law enforcement, judiciary, civil society, and government agencies is essential to address the root causes of GBV. Raising awareness, education, sensitization, and economic empowerment of women are pivotal in fostering a society free from gender-based violence. In conclusion, while acknowledging the strides made in legal interventions, this critical analysis emphasizes the imperative for a holistic approach encompassing legal, societal, and cultural dimensions to effectively combat gender-based violence in India.
