Abstract

The emergence of deepfake technology has introduced a paradigm shift in the landscape of information authenticity, posing multifaceted challenges to both defamation law and societal trust. This paper undertakes a comprehensive exploration of the profound implications of deepfakes on the legal construct of defamation and its ramifications within society. It delves into five key areas that elucidate the intricate interplay between deepfakes, defamation law, and societal dynamics. Firstly, the paper dissects the technological mechanics behind deepfakes, illuminating the ease with which manipulated audio and visual content can be created, often indistinguishable from reality. It scrutinizes the potential for misuse in generating defamatory content, blurring the lines between truth and fabrication. Secondly, it scrutinizes the evolving jurisprudence surrounding defamation in the context of deepfakes. By examining pivotal legal precedents and the challenges they present, this analysis navigates the complexities of establishing liability when dealing with synthetic yet damaging content. Furthermore, it investigates the societal repercussions of deepfake-driven defamation. The erosion of trust, heightened skepticism towards media, and the perpetuation of misinformation underscore the societal vulnerabilities exacerbated by the proliferation of such falsified content.
