Abstract

The Constitution of India ensures equality, freedom, justice and dignity of all individuals and implicitly mandates an inclusive society for all including persons with disabilities. The policies of the Government of India towards the welfare of persons with disabilities have been reflected in the enactments, schemes and through institutions established for various relevant activities. The Persons with Disabilities Act, 1995 imposes several obligations on the Central Government and State Governments for taking up various measures to ensure equal participation of people with disabilities in all walks of life. The Persons with Disability (PWD) at 1995, defines disability in terms of extent to impairment of body structure and body function. Disability rights have now become global rights due to the coming into force of the United Nations Convention on the Rights of Persons with Disability. thisThis world widely law reform is now well and truly underway in the field of disability rights–one that tackles the legacy of the past and helps create a more equal society and economy. Despite these large numbers, persons with disability are almost invisible in our public and social life. Whether congenital or acquired later in life, disability results in consequences that include marginalization in every sphere of life, be it denial of education, employment, recreation, income, identity, or social recognition.
